Abstract:  У статті проаналізовано законодавство України у сфері реклами, виявлено та досліджено окремі техніко-юридичні недоліки Закону України «Про рекламу» та їхній вплив на правозастосування, зокрема на появу правореалізаційних та правозастосувальних помилок. Запропоновано напрями усунення окремих недоліків рекламного законодавства України шляхом внесення змін і доповнень до Закону України «Про рекламу». В статье проанализировано законодательство Украины в сфере рекламы, выявлены и исследованы отдельные технико-юридические недостатки Закона Украины «О рекламе» и их влияние на правоприменение, в частности на появление правореализационных и правоприменительная ошибок. Предложены направления устранения отдельных недостатков рекламного законодательства Украины; предложено авторское определение рекламной деятельности.
Description:  The article analyzes the legislation of Ukraine in the field of advertising, identifies deficiencies in the Law of Ukraine «On Advertising» and develops relevant proposals to address them. It is noted that in order to improve advertising legislation, economic and legal tools should be used to ensure the optimal combination of market self-regulation and state regulation, which will ensure a balance between public and private interests of advertising entities. At the same time, when preparing draft normative acts, it is necessary to strictly observe the rules of legal technology. The author’s definition of advertising is proposed and the need for a legal definition of advertising as a type of economic activity is justified by supplementing with Art. 1 of the Law of Ukraine «On Advertising» with a part of the following content: «advertising is an independent, proactive, systematic economic activity at one’s own risk, aimed at making profit from the implementation of advertising work, the provision of advertising services and the provision of intermediary advertising services». The content of the concepts «advertising producer» has been clarified. Considering the fact that advertising is always distributed information, until the moment of distribution the same information is not advertising, a person called an advertising producer, under current law, cannot be considered as producing advertising until the relevant information is disseminated. Therefore, it is proposed to amend the Law of Ukraine «On Advertising» and formulate the paragraph 2 Art. 1 as follows: «producer of advertising is a person who, in whole or in part, brings information into a form ready for distribution in the form of advertising». The necessity of making amendments to Art. 27 of the Law of Ukraine «On Advertising» regarding the division of responsibilities of advertisers, producers and distributors of advertising is substantiated.
